This project is a commission to undertake a unique and major cross border research study in the Derry City and Strabane District Council (DCSDC) and Donegal County Council (DCC) Areas.
The research concept follows a series of dialogues between DCSDC, DCC in terms of the need to examine the physical land-use implications of Brexit upon the North-West Region of Ireland.
The commission will ask how landscape can be an agent in the shaping of the cross-border City Region. The commission’s starting point is the recognition that the North West City Region of Derry and Donegal has international and cross-border significance in the context of Brexit. It acknowledges that it will be part of the only land border between the UK and EU.

II.2.4) Disgrifiad o’r caffaeliad
This project is a commission to undertake a unique and major cross border research study in the Derry City and Strabane District Council (DCSDC) and Donegal County Council (DCC) Areas.
The research concept follows a series of dialogues between DCSDC, DCC in terms of the need to examine the physical land-use implications of Brexit upon the North-West Region of Ireland. Whilst focusing on the physical land use matters, implicit within this research will include in-depth economic, social/demographic, political and social analysis which will be key to informing the research outcomes and outputs.
The commission will ask how landscape can be an agent in the shaping of the cross-border City Region. The commission’s starting point is the recognition that the North West City Region of Derry and Donegal has international and cross-border significance in the context of Brexit. It acknowledges that it will be part of the only land border between the UK and EU.
The outcomes of the project will be presented in a final workshop to receive the final research report, namely “An Atlas of a City-Region” which is aimed at assisting a range of stakeholders including government (local and central), private sector and citizens.
This publication will be a comprehensive research document which will provide a detailed analysis and a practical ‘tool-kit’ for how key local and central government stakeholders (NI/ROI/UK) can respond to the economic, social, physical and practical challenges that arise from the Brexit process post 2019. The commission will draw upon international best research practice and provide a key reference tool to policy and decision makers that have a role and influence upon the NW Region.

Esboniad:
Due to detail of research and analysis required for this commission it is considered that an academic institution is best placed to complete this work. Universities have resources and systems in place as well as access to a varied pool of key internal research staff, students and specialist resources.
This research commission and its findings are considered to be of both national and international significance due to the challenges facing the NW region which unique to any other European region. The key consideration has been to identify an academic institution that can undertake these works.
Derry City and Strabane District Council and Donegal County Council have an established relationship with Harvard University in Boston dating back to over 20+ years. This relationship has been developed through various inward investment initiatives and research partnerships which have led to close links between government, business and academic stakeholders on both sides of the Atlantic.
Harvard University (through its Graduate School of Design) are an internationally recognised and prestigious academic brand that has the expertise to undertake this commission. They are familiar with the region and have a detailed understanding and knowledge of the regeneration, economic and investment challenges facing the NW region from a global academic perspective. Harvard University have previously undertaken research in Derry from 2005-06 in which its Graduate School of Design (GSD) undertook a detailed study in relation to the future regeneration options for the Ebrington site.
Whilst acknowledging that there may be other UK/ROI academic institutions who could assist with this commission, the national and international significance of this commission requires an internationally recognised academic institution. However, as part of this commission they will work closely with Ulster University and Letterkenny Institute of Technology to learn and share from each other as the research is undertaken.
Accordingly, both Councils are satisfied that Harvard GSD have the requisite experience, expertise and capacity to undertake this major commission for the NW Region.

The bringing of court proceedings against the Authority in advance of the contract being entered into will automatically prohibit the Authority from entering into the contract until the court proceedings are determined, discontinued or disposed of, or the court, by interim order, brings to an end the prohibition. The remedies that may be awarded by the courts before the contract has been entered into include the setting aside of the decision to award the contract to the relevant economic operator. The bringing of court proceedings against the Authority after the contract has been entered into will not affect the contract unless grounds for the imposition of special penalties under the Public Contracts Regulations 2015 can be established. Otherwise the remedies that may be awarded by the courts where the contract has been entered into are limited to the award of damages. Economic operators are entitled to write to the Authority after receipt of the notification should they require further clarification. The Authority will respond within 15 days of such a written request, but it should be noted that this may not prevent the Authority from entering into the contract. Where an economic operator is dissatisfied with the Authority’s response to its request for clarification, or considers that the contract has been concluded in breach of The Public Contracts Regulations 2015, such economic operator is advised to seek independent legal advice promptly.
