This is a single stage procurement and Bidders should submit both their completed Selection Questionnaires (SQ) and Supplier Submission Document (full Tender response) together by the deadline. Bidders should note that their Tender responses will only be evaluated substantively once suitability of the Bidders has been assessed in accordance with the selection criteria and minimum levels of suitability, as detailed in the SQ. Bidders who fail to satisfy the minimum requirements stipulated in the SQ will be eliminated from the process at this stage and their Tender response will not be subject to further evaluation.

Kirklees Council wish to commission an Advocacy Hub which consists of the following services:

— Independent Mental Capacity Advocacy (IMCA),

— Relevant Person Representative Services (RPR),

— Care Act Advocacy,

— General Advocacy,

— Independent NHS Complaints Advocacy (NHSCA).

Advocacy services are provided for eligible people to ensure that they are able to:

— have their voice heard on issues that are important to them,

— express their views and concerns,

— defend and safeguard their rights,

— have their views and wishes considered when decisions are being made about their lives,

— access information and services,

— explore choices and options.

The aims of the Hub are:

— to ensure the meaningful involvement and influence of individuals and groups in the care, support, and services that they receive,

— to raise the profile of advocacy and self-advocacy and work to promote and create a culture in Kirklees that encourages individual empowerment and involvement,

— to maintain a flexible organisational structure which facilitates links within the various elements of the Advocacy Hub, and is able to deal with fluctuations in demand,

— to develop strong working relationships with external organisations, particularly others providing advocacy, Healthwatch, the Council and health organisations.

The services are currently delivered under separate contracts and by different service providers, however the new Advocacy Hub Contract will be awarded to 1 successful economic operator, to deliver the full requirements of the service specification. Consortia bids will be welcomed.

The anticipated start date for the contract is 1.10.2018 or such other date as may be agreed. It is anticipated that the contract will be for 3 years with an option to extend for a further 2 x 12 month periods up to 30.9.2023, or other such date in line with the start date.

The estimated total annual value of the contract is 354 559,00 GBP. The current split across each of the service areas is:

Care Act Advocacy — 180 559,00 GBP.

IMCA and RPR — 120 000,00 GBP.

Independent NHS Complaints Advocacy — 54 000,00 GBP.

The Service is likely to be subject to the implications of the Acquired Rights Directive EU2001/23/EC and the Transfer of Undertakings (Protection of Employment) Regulations 2006 (SI 2006/246) (as amended) (“TUPE”). However it is a matter for the Tenderers to determine for themselves whether or not TUPE applies to their prospective Tenders, and it is strongly recommended by the Council that Tenderers seek their own independent professional advice (including any legal, financial or actuarial advice) in this respect in order to fully understand the potential consequences of TUPE before compiling and submitting their final tender submissions to the Council.

Due to the anticipated value of the contract the Council is running this procurement exercise under the light touch regime, as set out in the Public Contracts Regulations 2015. This is using a process akin to the open procedure but the Council gives no commitment at this stage.

III.1) Amodau ar gyfer cymryd rhan

III.1.4) Rheolau a meini prawf gwrthrychol ar gyfer cymryd rhan

The minimum criteria for consideration of this contract is described in the Selection Questionnaire document,under the “scoring and assessment” section. In summary Bidders will be assessed on their financial stability and ability to demonstrate an annual turnover of at least 531 839 GBP (1,5 times the estimated annual contract value), their previous experience of managing advocacy related services, and their commitment to meet the required levels of insurance. Bidders who fail to satisfy the minimum requirements stipulated in the SQ will be excluded from the process at this stage and their Tender response will not be subject to further evaluation.

Qualitative and financial criteria are outlined in the Invitation to Tender document, including minimum score thresholds for qualitative criteria. The Council reserves the right to exclude any Bidder whom they deem to not satisfy any criteria outlined within the Tender Documentation (available from the address at 1.3 above).

The Council intends to award the Contract to the Bidder(s) offering the Most Economically Advantageous Tender in accordance with the Evaluation Criteria and weightings detailed in the Invitation to Tender document. Quality forms 90% whilst Price forms 10% of the final score. The Successful Bidder will be the one which meets the Minimum Requirements in full, as stipulated in the Selection Questionnaire, and has the highest combined evaluation score (Quality and Price).

The Contracting Authority will incorporate a minimum ten (10) calendar day standstill period at the point that information on the conclusion of the Contract is communicated to tenderers. This period allows any unsuccessful tenderer(s) to seek further debriefing from the contracting authority before the conclusion of the Contract(s). Such additional information should be requested from the address at I.1 of this notice. If an appeal regarding the conclusion of the Contract(s) has not been successfully resolved, then the Public Contracts Regulations 2015 (SI 2015/102) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be started within thirty (30) days beginning with the date when the aggrieved party first knew or sought to have grounds for starting the proceedings had risen. The Court may extend the time limited for starting proceedings where the Court considers that there is a good reason for doing so, but not so as to permit proceedings to be started more than three (3) months after that date. Where the Contract has not been concluded, the Court may order the setting aside of the award decision or order the contracting authority to amend any document and may award damages. If however the Contract(s) has been concluded, the Court may only award damages or, where the contract award procedures have not been followed correctly, declare the Contract(s) to be ineffective.
