Crynodeb

Warwickshire and Coventry City Council are seeking either a single provider or a partnership bid to deliver Care Act Advocacy and Independent Mental Capacity Advocacy (IMCA) across Coventry and Warwickshire.

Care Act Advocacy will cover duties for s67 and s68 within the Act. It will be for individuals who are entitled to advocacy services under the Care Act 2014 to enable them to fully participate in their Assessment, Care and Support Planning, Adult Safeguarding and Reviewing enquiry process.

Under the Mental Capacity Act the Local Authority has a duty to provide an independent advocate for people who lack the capacity in certain circumstances when there are no known relatives or close friends to speak for them. This includes people whom are:

— covered by the Mental capacity Act (2005): the individual has no one other than paid staff with whom “it would be appropriate to consult”. The Code of Practice 10.74 — 10.78 provides more information about how this decision can be made,

— individual cannot consent / lacks capacity: the individual’s capacity to make the specific decision must be assessed. The MCA states:

1. they have an impairment or disturbance (for example, a disability, condition or trauma) that affects the way their mind or brain works; and

2. the impairment or disturbance means that they are unable to make a specific decision at the time it needs to be made,

— do not have family support,

— are not befriended.

IMCA provision must be available for people aged 16+ who may present with a wide variety of needs as defined within the Mental Capacity Act (2005).

Both of the services outlined within this specification are statutory services with access restricted to eligible individuals only. Access to both is referral via a designated officer within a care management team in Health or Social care, as specified within the following schedules, who meet the eligibility criteria within this service specification.

Care Act Advocacy:

The provider(s) will provide high quality advocacy which will support people to be fully involved in making decisions about their treatment, care, risks and support. Individuals will be supported to make clear their own views and wishes; and to express and present their views effectively in accordance with Care Act 2014.

IMCA:

The provider(s) will provide high quality advocacy which will support people to make specific important decisions: including making decisions about where they live and about serious medical treatment options in accordance with legislation and relevant acts.

The services will support the principles as stated within Appendix 2 (NDTi Advocacy Outcome Framework) and Advocacy Code of Practice to underpin good practice.
