Esboniad:

This notice does not relate to the award of a new contract, but rather the modification of an existing contract. The existing contract is between the National Library of Scotland and Connect Publications, commencing on 1.7.2015. Since then the Library has undergone an internal publications review. It has agreed to consolidate publications and significantly reduce their number. The Library is therefore currently reviewing its requirements re: publications and will issue a tender (PIN with OJEU ref.: 2020/S 025-058077). The Library proposes to extend the existing contract for 6 months to 31.12.2020 (‘the Proposed Modification’).

The Library considers that the proposed modification is not ‘substantial’, under Articles 72(1)(e) and 72(4) of Directive 2014/24/EU. Accordingly the proposed modification may lawfully be implemented without conducting a fresh procurement procedure.

The proposed modification is a short extension of time to allow for the preparation of a new tender opportunity and affords continuity of service by way of publication of the Winter 2020 Discover magazine, as well as the annual report due in July 2020 and consolidated publications. The proposed modification is therefore in relation to the same services as were procured under the original contract. i.e. corporate publications. It does not change the overall nature of the contract and the value is 15,15 % of the value of the original contract.

In addition:

(a) the modification does not render the contract materially different in character from the 1 initially concluded between the parties;

(b) the modification does not introduce conditions which, had they been part of the initial procurement procedure, would have:

(i) allowed for the admission of candidates other than those initially selected;

(ii) allowed for the acceptance of a tender other than that originally accepted; or

(iii) attracted additional participants in the procurement procedure.

(c) the modification does not change the economic balance of the contract or the framework agreement in favour of the contractor in a manner which was not provided for in the initial contract;

(d) the modification does not extend the scope of the contract considerably; and

(e) a new contractor is not replacing one to which the contracting authority had initially awarded the contract.

The Library therefore proposes to modify the existing contract as described.
