DCLG own a number of sites which are a mixture of occupied and vacant. Until such sites are developed, DCLG proposes to use them to provide car parking provisions to the public. DCLG is proposing to enter into a three year services concession arrangement with JustPark for these sites. The value of the service concession arrangement is considerably below the threshold level so is not covered by the Concession Contracts Regulations 2016. For this reason, DCLG is not running an EU procurement process and intends to award the contract directly to JustPark. The features of the service concession agreement are outlined below.
JustPark will provide all services relating to the parking facilities and be responsible for maintenance of the sites and marketing of the facilities. JustPark is responsible for generating revenue and will recoup its investment from that revenue. The revenue generated from use of the parking facilities is split between DCLG and its partner (DCLG taking the majority).
Where a site does not generate revenue, JustPark is at risk of losing its investment made in that facility. It is not guaranteed by DCLG.
DCLG may at any point require the return of the site and the cessation of operation of parking services on that site on one week's notice. Where this is done within a ‘minimum period’ from the point at which the site is made available to the partner (which will be specific to each site and designed to reflect the period of time required for the partner to prepare the site for the provision of parking services), DCLG will pay a withdrawal fee to the partner to reflect the fact it has not had an opportunity to generate revenue due to DCLG's withdrawal. After the minimum period, DCLG may withdraw the site with no charge.
