The Council intends to extend an existing Dynamic Purchasing System (“DPS") for the provision of home support services to include the provisions of those services to children between the ages of 0 and 18 years of age. The original DPS (which is referenced 2016/5099-160) related to the commissioning of home support services to vulnerable adults. The value of these additional services fall within the contract value of the original DPS.

The extension of the existing DPS does not render the contract materially different in character in that there will be no substantive changes being made to the types of services being procured under the same specification and payment terms. The Council considers that the extension of the current DPS is lawful for the reasons set out at paragraph 3 of Annex D1.

Esboniad:
Pursuant to Regulation 72(8) of the Public Contracts Regulations 2015 the Council considers it lawful to extend this contract for the following reasons:
The modifications do not render the contract materially different in character in that there will be no substantive changes being made to the types of services being procured, under the same specification and payment provisions, however for a different service user.
It is highly unlikely that the proposed modification would have attracted other bidders, allowed for the admission of other tenderers, or acceptance of other tenders. The DPS remains open and should any other bidders wish to provide any of the services advertised they will be permitted to do so provided they meet the criteria of the original DPS.
The payment mechanism will remain the same and therefore the incorporation of the additional services will not change the economic balance of the DPS contract.
The value of the additional services is within the contract value of the original DPS.
