Esboniad:

This is a joint procurement on behalf of Cheshire East Borough Council and Cheshire West and Chester Borough Council (the Councils) pursuant to Regulation 32(2) of the Public Contracts Regulations 2015 (the Regulations). Regulation 32(2)(b) of the Regulations permit the use of the negotiated procedure without prior publication where the works, supplies or services can only be supplied by a particular economic operator:

— where competition is absent for technical reasons, or

— the protection of exclusive rights, including intellectual property rights where no reasonable alternative or substitute exists and the absence of competition is not as a result of the artificial narrowing down of the parameters of the procurement.

The Councils requires the services of a Microsoft Dedicated Support Engineer to assist the Councils in their migration to the Microsoft Azure Cloud. The Azure Cloud is Microsoft's propriety infrastructure, for technical reasons and the protection of Microsofts exclusive rights in their infrastructure there is no reasonable alternative provider for the Microsoft DSE Services. For the reasons set out regulation 32(2)(b) applies to this procurement and consequently the negotiated procedure without prior publication may be used to procure the support services.

Cheshire East Borough Council will incorporate a standstill period on publication of this notice. The standstill period, which will be for a minimum of 10 calendar days, provides time for other economic operators to challenge the award decision before the contract is entered into. The Public Contracts Regulations 2015 (SI No 102 provides for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action i n the High Court (England, Wales and Northern Ireland).
