The Defence Academy, part of the United Kingdom Ministry of Defence, intends to award a contract to Cronos Consultancy Services Limited (the Contractor) to provide consultancy services and subject matter expertise in relation to key contracts to the Defence Academy to support its transformation programme on to meet its savings and efficiency targets. The Contract duration is three months and has an estimated value of 35 500 GBP net of VAT.
It is considered that the contract can be awarded to the contractor using the negotiated procedure without prior publication pursuant to Article 32(2)(b)(ii) of Directive 2014/24/EU and Regulation 32(2)(b)(ii) of the regulations on the basis that competition is absent and no reasonable alternative or substitute exists for technical reasons.

The current contract with Cronos Consultancy Services was contracted under the OJEU threshold and has delivered on a number of targets set by Defence Academy as part of the transformation programme to deliver savings, efficiencies and to hold the contractors to account in their contractual obligations on a number of high value contracts. There is a need to award a new contract to Cronos for 3 months to enable contractor to complete their outstanding actions to enable the Defence Academy to compete the next phase of the requirement.
The activity requiring completion is to review the effectiveness of two PFI Defence Academy Contracts and recommend how these should be managed. The additional activity is within scope of the original contract and the need to award a new contract is brought about by delays in the transformation programme which were outside of the contractors control, which impacted on the ability of Cronos to meet the delivery timescales set on the original contract.

Esboniad:
The Defence Academy, part of the United Kingdom Ministry of Defence, intends to award a contract to Cronos Consultancy Services Limited (the contractor) to provide consultancy services and subject matter expertise in relation to key contracts to the Defence Academy to support its transformation programme on to meet its savings and efficiency targets. The contract duration is 3 months and has an estimated value of 35 500 GBP net of VAT.
The contractor was originally engaged by the Defence Academy to provide the Services under a contract dated 27.3.2017, the value of which net of VAT was estimated at the time that the procurement procedure was commenced to be less than the applicable threshold under Regulation 5 of the public contracts regulations 2015 (SI 2015 /nº 102) (the regulations) and accordingly the Defence Academy did not seek offers in relation to the original contract via a contract notice published in the Official Journal of the European Union. The contract’s estimated value net of VAT is below the applicable threshold under Regulation 5, but exceeds such threshold when aggregated with the value of the original contract.
The contractor’s additional services based on its in-depth knowledge of the academy’s transformation programme are required for a short period only, where a change of contractor would cause significant inconvenience and a substantial duplication of costs for the Defence Academy, and accordingly the contractor is the only economic operator capable of advising and supporting the academy’s objectives efficiently and otherwise meeting all of its requirements under the contract. The Defence Academy intends to seek offers in relation to a replacement contract for the services after the expiry of the contract.
