Esboniad:
Provision of a contract for the air environment safety assessment tool, on-going technical support for existing and new licenses and user training.
The DE&S Airworthiness Team, part of the UK Ministry of Defence, intends to award a contract to Adelard LLP for the Air Environment Safety Assessment Tool- the requirements for which will be the purchase of additional software licenses, on-going Technical Support for both existing licenses and any new licenses procured and user training. The Contract will be for a duration of three years. The intended Contract start date will be 31.3.2019.
It is considered that this Contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 32(2)(b)(ii) of Directive 2014/24/EU (Regulation 32(2)(b)(ii) of the Public Contracts Regulations 2015) for technical reasons. This is on the basis that:
a) Adelard LLP are the only supplier able to provide software that meets all the MoD’s requirements, including its technical and airworthiness safety requirements. To utilize 3rd party software, software support and training would create significant and unacceptable risk to Air Safety across multiple Aircraft Platforms resulting in a loss of airworthiness and a substantial and unacceptable reduction in the operability of all the affected aircraft platforms;
(b) only Adelard LLP, as the Original Equipment Manufacturer of the Software, associated software support and training, have the necessary skills, experience and knowledge to provide the required technical support and user training; and
(c) only Adelard LLP have access to the necessary technical data, as they own the background IP to the software’s generic modules and source code required to provide the technical support.
