Cambridgeshire County Council is putting in place a framework for the provision of residential, residential dementia, nursing and nursing dementia care under the light touch provisions of the Public Contract Regulations 2015 (Chapter 3, Section 7). The framework will be open for applications throughout its duration and the authority intends to evaluate applications approximately every 6 months, but reserves the right to evaluate more or less frequently.
Any public body outlined in either Part I or Part II of the local authorities (goods and services) (Public bodies) Order 1972 may call-off this framework. Details of these can be found at http://www.legislation.gov.uk/uksi/1972/853/made

Each care home that is part of the framework application must be CQC registered. Care homes that are rated ‘Inadequate’ will be excluded from the framework. Where a home has a ‘Requires Improvement’ rating, the potential provider must supply an improvement plan and the authority may exclude a care home at its discretion.

The first round of framework applications will close at 12.00 on the 7.2.2020. The closure dates for subsequent rounds will be communicated to potential providers via the LGSS Procurement portal and contracts finder, or via another appropriate method.

The Council will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. Such additional information should be requested from (refer to address in part I.1). If an appeal regarding the award of contract has not been successfully resolved the Public Contracts Regulations 2015 (Chapter 6) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules, to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly. Where a contract has not been entered into the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the Court may order the ineffectiveness of a contract where serious breach have occurred in addition to any fine, the Court may instead provide for alternative penalties, either contract shortening, fines or both.
