The City of Edinburgh Council (the Council) is seeking to create a Flexible Framework Agreement which will support making sport and physical activities accessible to a wide range of children and young people, supporting them to maintain their health and wellbeing, as well as build their confidence and social networks.
This requirement is delivered under two types of services, day sports and physical activities and residential sports and physical activities, organisations can apply for one or both lots.
The Flexible Framework Agreement will be opened every two years to allow new sports and physical activities organisations to apply to be part of the Flexible Framework Agreement.

The Council is seeking to create a Flexible Framework Agreement in line with our commitment to getting it right for every child. Our priorities include helping children to be active, healthy, and nurtured, improving achievement, and closing any gaps in attainment.
It is expected that any Provider looking to deliver this Service will be able to;
- Support Improvement of attendance and achievement
- Make their sports and physical activities accessible to all children and young people
- Make their sports and physical activities fully inclusive to all children and young people
- Work in flexible and holistic way to complement the children and young people’s needs
- Address barriers to learning which can arise within the school community and individual children
- Provide evidence of outcomes achieved
The Flexible Framework Agreement is to cover all children and young people aged 4 to 18, across the whole of the city and aims to offer a wide range of sports and physical activities to cater for individual needs.

Residential trips will include sports and physical activities. The packages will be an all inclusive – transport during the visit (not to and from), food and accommodation where applicable which may be more than one night.

The Flexible Framework Agreement will be awarded on the basis of the Most Economically Advantageous Tender with 30% of the overall evaluation score given to price and 70% of the overall evaluation score given to quality (cost:quality ratio).
Schools and Active Schools will be able to call off from the Flexible Framework Agreement via direct purchases or Mini Competitions.

It is a mandatory requirement of this Framework Agreement that a prompt payment clause is present in all supply chain Contracts used in the delivery of the requirements. This ensures payment of sub-contractors at all stages of the supply chain within 30 days and includes an obligation to provide a point of contact for sub-contractors to refer to in the case of payment difficulties. This will require active monitoring of payment performance as well as the provision of evidence and reports to the Council on request or as contractually scheduled.

A tenderer that suffers loss as a result of a breach of duty under the Public Contracts (Scotland) Regulations 2015 may bring proceedings in the Sheriff Court or the Court of Session. The City of Edinburgh Council (the Council) will have a minimum standstill period of 10 days before awarding the contract. The communication of the award decision notice will be sent by fax or e-mail to all tenderers with the standstill period commencing on the next day. If proceedings are started in the Sheriff Court or the Court of Session against the Council in respect of the decision to award the contract within the standstill period then the Council is prevented from awarding the contract. Post contract award the Sheriff Court or the Court of Session may (1) award damages provided proceedings are brought within 3 months from the date when the grounds for the bringing of the proceedings first arose (2) be entitled to issue an ineffectiveness order or impose a financial penalty on the Council. A claim for an ineffectiveness order must be made within 30 days of the Contract Award Notice being published in the FTS or within 30 days of the date those who expressed an interest in or otherwise bid for the contract were informed of the conclusion of the contract or in any other case within 6 months from the date on which the contract was entered into.
