This contract notice is non-mandatory and is published on a voluntary basis by The Felixstowe Dock and Railway Company for the purpose of seeking expressions of interest in connection with Civil Engineering Term Maintenance Services. Please see the Additional Information supplied at Section VI.3) regarding the nature of this voluntary contract notice and the implications for the process to be followed in relation to this procurement.

II.2.1)

Cyfanswm maint neu gwmpas

The Company has a requirement for the undertaking of maintenance and Civil Engineering works incorporating ground works and a comprehensive range of other work types covering the infrastructure at the Port of Felixstowe.

The Contract will comprise of the undertaking of maintenance and minor civil engineering works including roads and footpaths, yard pavements, drainage, fencing, underground ducts and services, quay walls and berths, railway terminals, container yards, haulage parks, commercial buildings, development land and associated works.

The works are to be carried out in accordance with (but not limited to) the Construction (Design and Management) Regulations 2015, Specification for Highways Works, the Health and Safety at Work Act 1974 and associated regulations.

A designated compound area can be made available to the Contractor at the Port. The Contractor would be required to enter into a Licence to Occupy and would be responsible for paying the applicable rates.

The term of the Contract will be three years.

The anticipated commencement date is the 1.1.2017.

Note: TUPE may apply to this Contract.

The Company may request an interview to discuss the Potential Providers response to Part E of the PQQ (Tender Specific Questions) if some responses provided require further evidence or discussion.

This contract opportunity does not relate (wholly or principally) to an activity listed in the second column in Part P of Schedule 1 to the Utilities Contracts Regulations 2006 (the Regulations) and/or to an activity described in Article 12 of Directive 2014/25/EU of the European Parliament and of the Council (the Directive). Accordingly: (i) this contract notice is non-mandatory and is published strictly on a voluntary basis by The Felixstowe Dock and Railway Company; (ii) The Felixstowe Dock and Railway Company does not consider itself bound by the requirements set out in the Regulations and/or the Directive for the purposes of the competition and/or award of this contract opportunity; and (iii) The Felixstowe Dock and Railway Company reserves the right to depart from any or all of the procedures and/or requirements set out in the Regulations and/or the Directive regarding the competition and/or award of and/or any other matter relating to this contract opportunity at any time. Any reference to all or any part of the Regulations and/or of the Directive and/or any to procedure to be followed, relevant time limits to be applied and/or requirements to be fulfilled which appear, are referred to and/or are incorporated by reference into this contract notice, any pre-qualification questionnaire and/or tender documents issued as part of the procurement process shall be read and construed accordingly and shall not impose on The Felixstowe Dock and Railway Company any obligation to comply with the provisions of the Regulations and/or the Directive whether in relation to that matter or generally.”

The Felixstowe Dock and Railway Company shall not be responsible for any costs, charges and/or expenses incurred by any candidate and/or tenderer and accepts no liability for any such costs, charges and/or expenses.

All dates and time periods referred specified in this contract notice are only provisional and The Felixstowe Dock and Railway Company reserves the right to change any of these.

The Felixstowe Dock and Railway Company shall not be committed to any course of action as a result of the publication of this contract notice or any subsequent pre-qualification questionnaire and/or tender document. The Felixstowe Dock and Railway Company shall not be bound to accept any tender and reserves the right not to award a contract for all or any part of this contract opportunity and/or to amend, add to or withdraw all or any part of this procurement at any time.

The Felixstowe Dock and Railway Company currently intends to incorporate a non-mandatory and voluntary standstill period at the point it notifies tenderers of its decision to award the contract. Such voluntary standstill shall be adopted solely on the basis of good procurement practice and shall not indicate or be construed as meaning that The Felixstowe Dock and Railway Company shall be bound by the Regulations and/or the Directive in this and/or any other respect.”
