NHS Dudley CCG is procuring, on behalf of itself and Dudley Metropolitan Borough Council, a Multi-specialty Community Provider (MCP) for the delivery of a range of community-based health and care services for the registered patient population covered by the CCG and resident population of the Council. The MCP will, in summary:
— hold a contract of up to 15 years;
— manage a single, whole population budget;
— transform access to and delivery of community health and care services;
— meet a defined set of outcome and performance measures.
The services to be provided by the MCP include (among others):
— community-based physical health services;
— some existing out-patient services;
— primary medical services;
— urgent care and primary care out of hours services;
— adult social care services;
— mental health services;
— learning Disability Services;
— end of life care;
— activities currently carried out by the CCG.

It should be noted that during the course of this contract additional services could fall within the remit of the MCP that are not currently identified within its scope.
This could include social care and related services currently commissioned by Dudley CCG or Dudley Metropolitan Borough Council (or their respective successor organisations).
The possible MCP contract value range, based on 2016/17 budgets, is expected to be between approximately 3 495 000 000 GBP and 5 445 000 000 GBP, depending upon the extent to which Dudley CCG general practices are (or might become) fully integrated with the MCP, the inclusion of other general practices, the inclusion of social care services (see Section II.2.4) and whether the contract runs to its potential full term of 15 years.
The initial scope of the contract envisaged by this procurement is as described in Section II.1.4 of this notice. However, during the lifetime of the contract, the scope of the services undertaken by the MCP may be expanded beyond the provision of health services to cover (as well as health services) public health and/or social care services of the types currently commissioned by Dudley Metropolitan Borough Council, Dudley Clinical Commissioning Group and/or their respective successor organisations.
These may include, but not be limited to:-
— older people's care (including care homes, home care, dementia gateways and reablement services);
— learning disability services (including care homes, supported living, other community based provision); note — it is anticipated this will not take place until an All Age Disability service model has been fully implemented (estimated to be within 2 years);
— mental health services (care Homes / supported living / recovery model provision);
— services commissioned from the voluntary sector (low level preventative services);
— support services commissioned (for example managed budgets, advocacy, carers) and any other related ancillary services which support the public health and/or social care commissioning operations of Dudley Metropolitan Borough Council, Dudley Clinical Commissioning Group and/or their respective successor organisations.
Such expansion of the scope of the services may result in significant growth of the scope and/or quantity of the services provided by the successful bidder. Should the scope of the services expand in any or all of these ways, the successful bidder must commit to undertake them and will be expected to have the technical abilities and all of the resources to enable it to do so.
Integration with general medical practice is a critical feature of the model and this will be achieved in a manner that is consistent with the options identified in the MCP framework document, through either a ‘partially integrated’ or ‘fully integrated’ service model.
This will include practices which are not currently members of Dudley CCG but may become so in future subject to approval by NHS England in accordance with the Health and Social Care Act 2012.
It should be noted that in the event of any contract for primary medical services being terminated on the grounds of a breach, death, unlawful partnership, unlawful acts, criminal conviction, loss of premises, removal by a regulatory body, or removal from the Performers List, the MCP will become responsible for the provision of primary medical services to the patients registered with the relevant practice.
Whole Population Budget.
The MCP will hold a whole population budget. At present this is based upon budgeted 2016/17 pay and prices.

The Contracting Authority intends to use an eTendering system in this procurement exercise.
NHS AGCSU is managing this Procurement in accordance with the Public Contracts Regulations 2015 (as amended) (the ‘Regulations’). The Services being procured are Schedule 3 Services and NHS Arden & GEM CSU and the Commissioner it represents are bound only by those parts of the Regulations applying to the procurement of these services commonly referred to as the Light Touch Regime (LTR).
Whilst the procurement process is being referred to as a Competitive Dialogue, Schedule 3 of the Regulations provides the Commissioner with the flexibility to define its own process as long as it complies with the provisions of Regulations 74-76 (inclusive) of the Regulations.
The commissioner may require that the provider and/or members of its supply chain provide guarantees, bonds or other instruments of appropriate security for the due and proper performance of its or their obligations, in such forms as may be required by the commissioner or otherwise prescribed for any such purpose.

The duration of the contract is for a period of up to 15 years.
The CCG reserves the right not to award the contract in whole or in part and/or to withdraw the procurement at any stage and that it shall not have any liability for any bid costs.
