Esboniad
The award of the contract without prior publication in the Official Journal of the European Union (OJEU) is lawful as it is being conducted through a direct award under an existing framework agreement, in accordance with the provisions of Directive 2014/24/EU (Article 33), as transposed into the Public Contracts Regulations 2015 (PCR 2015).
The framework agreement in question was itself established following a fully compliant, openly advertised competitive procurement process, ensuring transparency, equal treatment, and competition in line with the Directive. The incumbent supplier (Lyreco UK Limited) was originally appointed as the most economically advantageous tenderer based on a robust evaluation methodology (60% cost / 40% quality), providing assurance of value for money and capability in a previous open competitive tender process.
Under Article 33 of the Directive, contracting authorities are permitted to award specific contracts (call-offs) without further competition or publication, provided that the terms governing such awards are clearly set out within the framework agreement. In this instance, the framework allows for direct award where the supplier is best placed to meet the requirement, and the use of this route is consistent with those predefined terms.
Furthermore, the decision to utilise a direct award is supported by operational urgency, as confirmed by the Health Records team, with existing stock levels projected to be depleted within three months. Conducting a new open procurement would introduce a significant risk of supply disruption, potentially impacting the safe handling of patient records and continuity of care. The direct award therefore represents a proportionate and justified approach, balancing compliance with the need to mitigate operational and clinical risk.
In conclusion, the award without prior OJEU publication is lawful as it is made within the scope and rules of an established framework agreement, which itself satisfies the Directive’s requirements for competition and transparency, and is further justified by the need to ensure continuity of supply and maintain service delivery.
