Esboniad
The Public Contracts (Scotland) Regulations 2015 make provision for direct award of contract in certain limited circumstances. Regulation 33 of the 2015 regulations provide that a contracting authority may award a public contract without going to the market where the works, supplies or services can be supplied only by a particular economic operator because competition is absent for technical reasons and where no reasonable alternative or substitute exists and the absence of competition is not the result of an artificial narrowing down of the parameters of the procurement.
