Crynodeb

It is the Contracting Authority's preference to enter into a contract with Solent NHS Trust. The proposed contract is for a period of 12 months commencing 1st October 2022.

Background:

The five Hampshire Clinical Commissioning Groups tendered the Hampshire Therapies service for children and young people during 2012/13. The service provides speech and language therapy, occupational therapy and physiotherapy for children aged 0-18; the specification also covers MSK in some areas and timely completion of Education, Health and Care Plans, in line with health's statutory duties as outlined within the SEND reforms of 2014.

Solent NHS Trust was the successful bidder for both the North and South lots and commenced service delivery 1st May 2014 for a flat 4 year contract that expired on the 31st March 2018.

In 2018, a Prior Information Notice was published advising the market of the intention to extend the contractual arrangement by direct award until 31 March 2020 to allow for an ambitious programme exploring options for an integrated service model that would combine a range of different services, for example, Health Visiting, School Nursing, Special School Nursing and Immunisations and Vaccinations across the NHS and the Local Authority.

Following an extensive review and stakeholder events, an integrated model was not pursued due to a number of reasons and the services remained in place via separate arrangements. Due to impacts of commissioner capacity, in part due to Covid19 and staff redeployment in response to the pandemic along with staff vacancies, the CCG was unable to meet the procurement deadline of 31st March 2020 and a second Prior Information Notice was published advising the market of the intention to extend the contractual arrangement by direct award until 31st March 22 was published.

In late 2020, a Procurement Board to govern the progress of the programme as well as four workstreams was established with attendance from system wide, multi agency professionals as well as parent/carer representatives. The objective of the programme is to fully review the current service and identify service gaps/areas for improvement, based on historical performance data and feedback from parents/carers, other key stakeholders and the current provider. Following the review, a new service specification and budget will be developed and commissioners will enter into a competitive procurement.

Although direct impacts of Covid19 in terms of capacity are no longer causing significant delays to commissioner roles, secondary impacts such as lack of sight of performance data prevented the programme from progressing. In addition, Commissioners recognised that families were only just beginning to move back to normality following lengthy pandemic related restrictions (example school closures) and would not have had time to respond to requests for views around the current service until Covid-19 restrictions and pressures eased. The CCGs therefore agreed to extend the contract by direct award until 30th September 2022. The extension did not include any additional investment.

Although the procurement board has been operating effectively, delays relating to challenges obtaining accurate activity and performance data has caused a considerable slippage to the project which puts the procurement process at significant risk. Data has now been received and the project team is working to understand activity to inform the service specification redesign as well as CCG financial forecasting. A revised budget to meet increased demand is anticipated by commissioners. Therefore, time is required to develop a business case for this additional funding as well as be approved though appropriate governance routes for both HSI CCG and Frimley CCG.

It is the Contracting Authority's preference to enter into a contract with Solent NHS Trust for the reasons detailed below.

The proposed contract is for a period of 12 months commencing 1st October 2022. If however, there are expressions of interest in competing to deliver the requirements, it should be noted that the Authority will proceed with a competition process in accordance with Public Contracts Regulations 2015 for a 5 year plus 24 month extension option contract for a sole provider.

If no expressions of interest are received, the Authority will enter into a contract with the above named provider, relying upon a Regulation 32 exemption of no response/no requests to participate have been submitted in response to this notice.
