Gwybodaeth Ychwanegol

The Services to which this Procurement relates fall within the scope of ‘Part B Services’ as defined in the Public Contracts Regulations 2006 (as amended) and Directive 2004/18/EC. Therefore the 2006 Regulations and the 2004 Directive are only applicable to the Service Procurement to the extent required for Part B Services.

For the procurement of healthcare services for the purposes of the NHS within the scope of the National Health Services (Procurement, Patient Choice and Competition) (No. 2) Regulations 2013 (the NHS Regulations), there is a temporary exemption from the Public Contracts Regulations 2015, which generally means that healthcare services, when procured by CCGs and NHS England, will continue to be subject to the Public Contracts Regulations 2006 (the 2006 Regulations) until 18.4.2016.

NHS Commercial Solutions will incorporate a voluntary standstill period at the point information on the award of the contract is communicated to tenderers. That notification will provide full information on the award decision. The standstill period, which will be for a minimum of 10 calendar days, provides time for unsuccessful tenderers to challenge the award decision before the contract is entered into

The Public Contracts Regulations 2006 (SI 2006 No: 5) as amended by the Public Contracts (Amendment) Regulations 2009 (SI 2009/2992), as amended by the Public Contracts (Amendment) Regulations 2009 and the Public Contracts (Miscellaneous Amendments) Regulations 2011 provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland).
