Disgrifiad byr o'r contract neu'r pryniant/pryniannau

Recreational, cultural and sporting services. General management consultancy services. Construction work. Suffolk Coastal District Council is seeking to engage a strategic leisure development partner in respect of it's future leisure development programme which will cover the development of various leisure facilities across the Suffolk Coastal District Council area. It is the intention that other Contracting Authorities namely Great Yarmouth Borough Council, North Norfolk District Council, Bolsover District Council and North East Derbyshire District Council may in the future wish to utilise this contract, subject to the Contracting Authority's agreement, if any contract awarded. Note that no services are guaranteed for this contract (if any contract awarded). Bidders need to be aware that any fee earnings will be based through agreed projects (if any) as set out in Appendix O2 The Project Agreement.

The Strategic Leisure Development Partner shall provide a Performance Bond, Cash deposit or alternative security if required by the Council. The Strategic Leisure Development Partner shall provide the Council with such information as is reasonably required in order to determine whether to require such surety.

If the contract is awarded to a consortium, joint venture or alliance, applicants will be required to contract with joint and several liability under English Law and either nominate a lead service provider with whom the Contracting Authority can contract and to whom all communications will be addressed or form into a single entity before the contract is awarded.

Key Performance Indicators (KPI's) as listed in Appendix O1 The Partnering Agreement relating to the development of the Council's Leisure portfolio. KPI's may be subject to change over the duration of the contract (if any contract awarded). Insurance levels required by the contractor; 10 000 000 GBP Public Liability Insurance, 10 000 000 GBP Employers Liability insurance, 10 000 000 GBP Professional Indemnity insurance and 10 000 000 Third Party Insurance.

The Authority will apply all the offences listed in Article 45(1) of Directive 2004/18/EC (implemented as Regulation 23(1) of the Public Contract Regulations (PCR) 2006 in the UK) and all of the professional misconducts listed at Article 45(2) of Directive 2004/18/EC (see also Regulation 23(2) in the PCR 2006) to the decision of whether a Candidate is eligible to be invited to tender.

Candidates will be required to answer these questions as part of the qualification process. For candidates who are registered overseas, you will need to declare if you have any offences/misconduct under your own countries laws, where these laws are equivalent to the Regulation 23 lists.

Candidates who have been convicted of any of the offences under Article 45(1) are ineligible and will not be selected to bid, unless there are overriding requirements in the general interest for doing so.

Candidates who are guilty of any of the offences, circumstances or misconduct under Article 45(2) may be excluded from being selected to bid at the discretion of the Authority.

The Council reserves the right not to award any contract for the Strategic Leisure Development Partner. It should be noted that Suffolk Coastal District Council (SCDC) and Waveney District Council (WDC) are working in partnership and share a Senior Management Team. Whilst SCDC is the contracting authority for the purpose of this procurement process and any ensuing contract, WDC are acting as SCDC's representative in relation to the provision of Strategic Leisure Development Partner and procurement advice and process. Officers and Members at both councils will be involved in the process for contracting with an appropriate contractor. All dates and time periods specified in this notice are indicative only and the Council reserves the right to change these. The Contracting Authority will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers, fully in accordance with paragraph 32A of the Public Contracts Regulations 2006. This period allows unsuccessful tenderers to seek further debriefing from the Contracting Authority before the contract is entered into.
